LEGAL DISCLAIMER

It is the customer's responsibility to read through each section of this agreement. Away We Go Travel is acting as a mere agent for suppliers in selling travel-related services, or in accepting reservations or bookings for services that are not directly supplied by this travel agency ( such as air, ground transportation ,accommodations, hotels, meals, cruises, and tours etc) This agency, therefore, shall not be responsible for breach of contract. All rates are subject to availability, black out dates, conditions and some restrictions apply. As an online travel agency we try to provide the best products and services.


PAYMENTS

Away We Go Travel accepts Master Card, Visa, Money Orders and Certified funds only. No cash, personal checks or C.O.D. service. All prices are shown in U.S. currency.


TICKET FEE POLICY

A non-refundable processing fee of $30.00 is charged for every airline ticket transaction. This fee maybe waived when booking other arrangements at the same time. On changes to previously issued tickets that require new tickets to be issued, a service fee of $25.00 will be charged. There is no service fee on hotel, rental car, cruise or vacation package transactions made with Away We Go Travel.


SHIPPING & DELIVERY POLICY

Away We Go Travel can ship to virtually any address in the world. Tickets will be sent to your credit card billing address. Paper ticket(s) can be delivered to a P.O.Box when sent via U.S. Mail, but cannot be delivered to a P.O.Box when being sent via Fed Ex.

Away We Go Travel automatically ships your package within 24 hours of receipt and review off all documents from our suppliers. We have agreements with Federal Express. You may track your package on their web site.

Buyer bears the cost of all shipment of goods. Shipping cost is $15.00 U.S. when shipped to the United States. Shipping outside the U.S. will range from $20.00-$35.00 U.S. These charges are non-refundable and will appear as a separate charge on your credit card.


CANCELLATION AND REFUND POLICY

Any cancellation is the customer's responsibility. Cancellations can be made only by fax request.

Upon cancellation of the transportation or travel services, where the passenger is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the passenger, all sums paid to Away We Go Travel for services not provided will be promptly paid to the passenger, unless the passenger advises Away We Go Travel in writing, after cancellation. This provision does not apply where Away We Go Travel has remitted the payment to another registered wholesale seller of travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service. In this situation, Away We Go Travel must provide the passenger with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of travel, proof of current registration of that wholesaler.

ALL shipping, service, consulting, concierge, and ticket fees are
NON-REFUNDABLE.

If Away We Go Travel Customer Service has processed a refund for you, it will take, on average, two to three billing cycles to process. (About 60-90 days).


TRAVEL CONSUMER RESTITUTION FUND (TCRF) DISCLOSURE

Transactions are covered by the California Travel Consumer Restitution Fund (TCRF) if the seller of travel was registered and participating in the TCRF at the time of sale and the passenger is located in California at the time of payment. Away We Go Travel is a member in the TCRF. Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50. For transportation or travel services which the seller failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000.
A claim must be submitted to the TCRF within six months after the scheduled completion date of travel. A claim must include sufficient documentation to prove your claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a TCRF claim. NOTICE- Away We Go Travel's principal place of business is located in Poway California. For ALL passengers purchasing from outside of California, transactions are NOT covered by the Restitution Fund.

Passenger's purchase money is protected under the Seller of Travel Act.
California law requires certain sellers of travel to have a trust account or bond. Away We Go Travel has a trust account.

All persons entering this agreement on behalf of the participant represents to Away We Go Travel that he or she is at least 18 years of age and has all requisite power and authority to enter into this agreement on behalf of the participant, and that this agreement will constitute the legal valid and binding obligation of the participant.


INDEMNIFICATION

You agree to indemnify and hold Away We Go Travel and our subsidiaries, affiliates, directors, employees harmless from any claim or demand, including reasonable attorney's fees and costs, all third party due to or arising out of any breach by you of these terms of use (including, without all documents incorporated by reference), or your violation of any law or the rights of any third party.


USER AGREEMENT

Agreement between customer and Away We Go Travel. This web site is offered to you, the customer, conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of this web site and our contracts constitutes your agreement to all such terms, conditions, and notices.
By providing personal information through this website, you signify your agreement to the terms of our privacy policy. If you do not agree with these terms, please do not disclose any personal information through this site. You will be responsible for all changes incurred while your account is being used, if any, including payment for any goods or services.

(Please review our Disclaimer of Liability) Should a problem arise we ask that you always contact us first to make a good faith effort to seek resolution directly.

NOTIFY US IN CASE OF ERRORS OR QUESTIONS

Review all documents upon receipt. Notify us in case of errors or questions within 48 hours. We must hear from you no later than 2 business days after you have received them if there is an error or a problem appears for us to honor our guarantee policy.


CREDIT CARD PURCHASES

If you have a problem with Away We Go Travel bookings, tickets, travel arrangements and or reservations. If purchased with a credit card and you tried in good faith to correct the problem with us, we will credit original payment method less any shipping, service, consulting, concierge, and ticket fees per our business policies.
PLEASE NOTE if booked directly with our suppliers any refunds are subject to there guidelines and policies. Please review our Liability Disclaimer, Cancellation, and Refund Policies.


PRIVACY AND SECURITY POLICY

Away We Go Travel does not sell or rent your personal information to any other agencies for marketing purposes. Protection of your privacy is very important to us. We have taken strong measures to protect your personal information. We understand that you and your information are our most important assets. We store and process your information on our computers located in California. We have taken precautions to protect your data from loss, misuse, or unauthorized access. Your information is protected by technological security devices.

Away We Go Travel.com, Away We Go Travel.net, and the Away We Go Travel logo, are trademarks of Away We Go Travel. All such trademarks, trade names and services marks are proprietary to us and may not be used in connection with any products or service that are not Away We Go Travel's.
